The Study On The Problems And Solutions In Archival Administrative Law Enforcement

Striding into the new century, our country enters the new stage that comprehensively advancing rule of law and building a country under the socialist rule of law. The party’s Fourth Plenary Session of the 18th CPC Central Committee puts forward a clear-cut stand to stick to the socialist road under the rule of law with Chinese characteristics and build a socialist legal system with Chinese characteristics. As a part of the great cause of socialism, archives management plays an important role in the overall national development strategies. Along with the constant deepening of reform and opening-up and the further improvement of the system, the archives management of our country has made great progress, and achieved good results. However, influenced by traditional concepts and archives administration system, together with the other reasons such as the current archives laws and regulations is not perfect and enforcement mechanism is not sound, there are many problems int the work of archival administrative law enforcement. The difficulty of Archival Administrative Law Enforcement becomes an urgent problem to be solved in the field of archives. Because its solution is both the important guarantee for the realization of archives laws and regulations, and the urgent need to safeguard the lawful rights and interests of citizens, legal persons and other organizations.Based on the current work practice of archival administrative law enforcement, through exploring the current problems that exist in the law enforcement work, this article analyze the reason that cause problems to appear or exist and seek the countermeasure to ease or to solve archives administrative law enforcement problems.First of all, on the basis of the current research results on the issue of archives administration law enforcement, this paper introduces the research background, research methods and ideas, and explains the theoretical and practical significance of the research on the problems and countermeasures of archives administration law enforcement, also realizes the shortage of the research. Secondly, combined with relevant case this paper analyzes the main problems existing in the present work of archival administrative law enforcement on the four major aspects of the relative person, the subject of the archives administration, the law enforcement basis, the law enforcement environment. Then in the view of these four aspects of legislation, it gives an in-depth analysis of the reasons for the difficulty of law enforcement on seven aspects of law enforcement personnel, objects, conditions, institutions, procedures and the external environment. Thirdly, based on the analysis of the first two parts, this article expands a corresponding countermeasures research and expects to improve and promote the archives administrative law enforcement work from archives legislation, file consciousness, law enforcement team construction, law enforcement procedures, supervision mechanism and so on. Finally, the paper analyzes and presents the practice, achievements, experience and problems of the archives administration of Lin Shu County in Shandong Province in recent years in order to provide practical support for the view of this paper.
