To regulate the order of the cyber space and protect the freedom of expression, on 9th September, 2013, the supreme people’s court and the supreme people’s procuratorate< the interpretation on the criminal case of slander made use of the internet>, for the first time, to clear the standards and rules of implementation of libel, troublemakers, extortion, illegal operations such as standards on information network of sentencing criminal cases into sin. For some objective conditions, lots of disputed cases is appeared by managing online rumors. Which incur the attention from academic. It means accusation of online rumours in the law nowadays in our country is fuzzy. Internet rumours has polytropism, which make lots of rumours is not harmful to social be put into the sanctions circle of rumor network system, which resulting in judicial predicament.Suiting punishment to crime is one of the basic principal of the law. It is open to discuss about law-enforcing department do the punishment subjectively on some rumors without visible social detriment. False information may not have social detriment. Online society should have a basic tolerance to bear some rumors without detriment. To identify the level of online rumors is an important problem in todays social.In order to solve this problem,this article is from the core concept of social detriment, refined by the research method of questionnaire, statisticed as the breakthrough point,centred upon how to distinguish normal online rumors with illegal rumors and show the social determent, used research status in china and abroad, explored standardised institutionalisation of online rumors by the government。There are four parts in this thesis organised, Part 1 is introduction. Raising a question and introducing the basic concept with the research results in China and abroad. Both part 2 and part 3 are the most important subject in this essay, design of questionnaire is introduced in part 2, data was been classified statistic, and summarises the data to reflect the law, in order to explain the impact of differences audience in network rumors; Further more, third chapter puts forward the quantitative formula of social detriment of online rumors, analysis the affective of the three important elements in formula, with the analysis of a case,which is proposed a preliminary assessment of the standard of harmful for network rumors to society. Link the above, in the fourth chapter, with reference to foreign advanced management experience, our governance network rumors put forward countermeasures and suggestions.
