Punishment educati on and apprec iat ion educat ion occupi es the equal position in education and teaching practice, and both are excellent means of educational t eaching and management process.However,in the present sys tem of educational m anagement,punishm ent education has not played a real rol e.Firs tly, the problem is not the intrinsic val ue of educati on punishment, but the subject of educational punishment is in the lack of proper punishment and qualiti es which results in the overuse phenomenon of abusing of the punishment authorit ies.Secondly,the loss of punishment authority is severe, partly because in recent years the frequent cases of corporal punishment phenom enon, t he value of exi stence and meaning of educational puni shment i s denied by the whole society.On the other hand, there is the lack of ex plici tness and regulation of educational l aws and regulations for teachers and punishment authorit y.In o rd er to solve the cu rrent dilemma,the respec t of the legislation and constructi on of the s ys tem for teachers’ punishment authority has been one of the important issues of the current lega l resea rch worker s and teachers.In addi tion to the legislative authority of the legislative process and l egi slative rules, the punishment power of teachers’ and legislation should be also based on the deeply researc h and analysis of those i ssues surrounding teachers’ disciplinary rights,and as a basis for building the concept and struct ure of the disciplinary aut hority of teachers in our l egislation. Teacher discipline right philosophy and structure is based on legisl ati on in order to safegua rd the interests of students,teachers rights and regulate the exerci se of di scipline, disci plinary s ys tems and proce dures t o improve the necessity, through com parati ve study of foreign teachers’ rights to discipline and the legi slative history and the regulat ions foundation, phil osophy and strive t o design legi slation as mountains open road to s eek punis hment power of teachers laid the cornerst one of our legislation. Legislation idea is to regulate the legislative sys tem design, development of legi slative activit y leading standard value, m anifested i n the theoretical guidance on legi slation, legi slative purpose, basis, princi ples andprocedures, the value theory teacher discipli nary authority legislation. S tructure of Teachers disciplinary rights legisl ati on that theory of practice sublimation, is through the main legal rel ati ons,ex ercise principles, exercise mode,exerci se progr am and overseeing t he legislation of relief mechanisms to a reasonable standard punishment power of teachers legitimate exercise,so as to continuous ly improve content discipli nary st ructure safegua rds the int erests of teachers and students of design.Thus,the concept and structure of teacher di sciplinary rights legi slation i s tryi ng to focus on the concept of constructi on and struct ure default, combined with the development and current situation of foreign teachers ’discipl inary rights legi slation of the research for the legitimate exercise of the disci plinary authority of teache rs to teach and prac ti ce the law theoret ica l and practical value concept proposed feasibili ty of the proposal.
