During the last years, it is clearly defined in many Chinese educational law and regulations that teachers'corporal punishment and corporal punishment in disguised form on the students are forbidden. However, punishment isn't forbidden in any educational law and regulations. Actually , in educational activities ,teachers usually punish the students who didn't obey the rules. But it's very difficult because there are no clear and definite laws and regulations on it. Teachers cant't clarify punishment , corporal punishment and corporal punishment in disguised form on the students. More seriously , it causes some teachers infringe upon students'human rights, and that makes bad effects.The implementation of the Punishment Power of Teachers is the key link .This thesis is based on abroad investgation and chatting method among teachers, students, parents, schools in order to know the status quo of the punishment power, exploring the existing problems during the concrete implementation of the punishment that did by teachers, so as to analyses the effect caused by the lack of the punishment power of teachers in law and the methods how to solve the problem. This thesis falls into five parts.In the first part, the article differentiates and analyses the words of punishment and corporal punishment, power and right. The author clarifies the concept of the Punishment Power of teachers. Especially argues that punishment is teachers'power of office not the right of teachers. And the power should be written into educational law and regulations.In the second part, the author collects all the educational laws and regulations on compulsory education and find that there are no the concept about the punishment power of teachers. At the same time, there are no regulations about how to use punishment on students. If the teachers'or the students'rights are intruded, there are no good ideas to protect them.In part three, the author invests the implementation status quo of the punishment power of teachers in rural and city schools between teachers and director of the class. So as to find the problems and the reasons about the implement of the punishment power of teachers.In part four, the author analyses the series bad effects for the absence of the punishment power of teachers in law. teachers in law. It will resists us to administer education. It isn't good for the students to observe disciplines, and it is bad for the relations between teachers and students.More seriously, some teachers may be tired to do their work, it may cause a drop in moral standards on their duty.In the last part,the author tries to explore better methods to solve the problem, the author emphasies that we should try to complete educational laws, improve the principle on how to manage students, and raise the quality of compulsory education.
