How to promote industrial cooperation, will directly affect the construction of harmonious labor relations, and even the construction of a harmonious society. And is "psychological contract" a worker on the of shared mental labor unit development interests and investors and to hire workers to share the organization of certain interests prompted employees better create wealth for the organization to count on psychology. Development, has achieved remarkable results. It reflects the reality is a labor management cooperation and relationship of corporate profits "creating and sharing together", this relationship in modern society with economic globalization, the global market and the market competition, is becoming more and more object of legal adjustment, especially the developed capitalist countries in an ESOP legal system to adjust the psychological contract relationship, construction of system and mechanism of labor management cooperation, increase the vitality of enterprises and improve the market competitiveness of the enterprises, has achieved significant results.This paper intends to start from the perspective of psychological contract, expand the idea of improving the legal system of labor and capital cooperation. Then, it analyzes the status and function of labor and capital cooperation in harmonious labor relations, and deduces the necessity and feasibility of the law to promote the cooperation between labor and capital., in view of psychological contract, law on labor management cooperation in foreign countries promote system were studied, in share based on the practical experiences of other countries, mainly describes the United States, Germany, Japan, the three countries in the implementation of cooperative labor law to promote of our country important enlightenment. Finally, in based on the basis of China’s national conditions, from the perspective of psychological contract to promote cooperation and capital of our country legal system perfect, focusing on from the establishment of the labor management cooperation promotion law "and improve the supporting legal system(including creation of ESOP law and in labor law established collective rights of workers, improve workers collective bargaining rights legal system, perfect the relevant legal system of the Union) two aspects to perfect law system of promoting cooperation and capital of our country, some suggestions were put forward.Now our country implemented the reform of market economic system has increasingly deepened, beside the labor law and the labor contract law, and to promote cooperation between labor and capital legal system to adjust relations of cooperation between employers and employees, and actively play the role of psychological contract and better implementation of this law, has become the important content of the modernization of the national system of governance, which will be conducive to our implementation of the reform and opening up and sharing of results, mobilize all positive factors, promoting the construction of socialist modernization. |
