Study Of Legality Of The Individual Expression In Academic Power

In the process of building the modern university system, academic power expanding has gives teacher more and more independent power. And this kind of independent power has been included two kinds of power which are teacher engaged in the individual academic work and participate in the college management. As a type of academic power expression under the environment of strengthening the academic power and weakening the organization management, individual expression also need some attention. For deepening the connotation of academic power when it only state from the organization expression in the past, this paper has done a multiple analysis on the individual expression of academic power. And it also provides a theoretical basis for the legitimate exercise of individual expression of academic power.This paper has mainly uses the literature research method, historical analysis, interdisciplinary research method and test analysis method, starting from the theory of legitimacy from the perspective of David Easton, combined with the political legitimacy theory of Max Webb and John S Brubaker’s epistemology and political philosophy to clarify the origin of individual expression of academic power and its development on the basis of using the historical analysis method, and it also combined with the content of legitimacy theory to explore the legal foundation of individual expression of academic power which are academic capital, the law basis and public liability. Based on the legitimacy foundation, it expounds the content, mode and function about the individual expression of academic power. Then, combined with the specific content of legal theory, we discussed the relationship between the individual expression of academic power and the academic freedom, legal statutes and the teachers’ individual princedom. At last, we analyzed the problems which existed in the process of the individual expression of academic power and to regulate the legitimacy boundary of the power exercise. The thesis thinks, to improve the teachers’ individual academic responsibility, and to form the academic ethics and spirit; adhere to the basic principles of legitimacy; strengthen the power restriction and supervision and to establish a solid security system are the basis of legitimacy expression of individual academic power.The innovation point of this article: firstly, system and clearly raised the academic power of university has two forms of expression which are individual expression and the organization expression, and made a new explanation on the connotation of academic power, it has a certain novelty in the research object and research fields. Secondly, from use the legitimacy theory to raise the legitimacy criteria of individual expression which are academic capital, the law basis and public responsibility.
