Research On The Historical Evolution And Development Of The Rights Protection Legal System For Sports Participations For Disabilities

With China achieving outstanding results in Athens, Beijing and London Paralympic Games, the opportunity to develop the cultural industry for people with disabilities have emerged. However in today’s society where the competitive sports for people with disabilities is on the rage, the situation of the general development of sports for people with disabilities should be paid more attention, especially the legal systemBeing engaged in various sports activities is the legitimate right for people with disabilities and an excellent approach for them to rehabilitate and fit into the society. Sports provide people that guarantees the rights for people with disabilities to take part in sports with disabilities chances to realize their own values. However, due to the related law is rather immature and of little binding effect, it is still quite difficult for people with disabilities to enjoy the benefits of sports like everyone else. It is known that people with disabilities constitute to a large proportion of the population, and sports are very effective in making them healthy both physically and mentally. Therefore, the protection of the equality of people with disabilities to take part in sports contributes to the prosperity of China’s sports industry. However, because of the restriction on economy, laws and people with disabilities themselves, current legal protection for the disabled to take part in sports cannot meet the demand. Focusing on the legal protection for people with disabilities to take part in sports, the author will discuss about the approach to optimize the current legal systems. Drawing on and discussing those more advanced approach used in other countries to guarantee the equality of sports and, the author proposed some methods to protect the right of taking part in sports of people with disabilities.The research methods in this thesis include documenting, comparison, logical analysis etc. By analyzing the current laws on protecting the equality of people with disabilities to participate in sports, and comparison between China’s development on sports for people with disabilities with other countries, the author tries to summarize the Chinese efforts on the protection for the disabled right to participate in sports. Putting forward methods to tackle existing problems, the author wish the legal protection for the sports equality for people with disabilities can be taken to a new level.The right to take part in sports is a basic right for people with disabilities that need to be protected by a strong and effective legal system. Sports for people with disabilities are still quite ignored in China. The principle of "reasons & convenience" should be taken into account in the related policy making later on. By issuing concerning laws to ensure the equality can the basic right of people with disabilities to take part in sports be guaranteed.
