The equal right of learning is one of the basic human rights, meanwhile, middle school students are in the changing period of values and world out. The learning rights of "Backward students" are not guaranteed, and it significant impact the growth of students, so, it has important significance to research the equal rights to students’learning rights. At the same time, equal learning rights of the backward students are a very sensitive topic, and this is an unavoidable things to all educators.The equal learning rights are that whether the students talented or not, should have equal rights, equal opportunity, equal rules, to obtain the learning freedom, learning condition guarantee, and the personality development rights. Equal learning rights mainly include three principles:none difference treatment principle, according to the proportion principle and remedy principle. None difference treatment principle to ensure equality in form, according to proportion principle and remedy principle to ensure the equality in essence. Actually, the equality is the balance and coordination between the several principles. But, in fact, no matter how to balance these principles, it is impossible to achieve a perfect result, cannot eliminate disputes in the equal learning rights, especially in real life,"backward students" non-existence is just a wishful thinking The actual situation is there must be excellent and backward, because of different position, balance result basically is rational and emotional coordination and compromise, in other word, equality if relative.This paper consists of three parts:the first part is the research background, topic theory significance and practical significance, the internal and abroad research working present situation and the related basic concepts of research content. In generally, the research motivation can be summarized as tow aspects, the first is the personal history experience driven, and the second is concern and worry on the present "backward students" equal learning rights. The learning rights of middle school "backward students" has been deeply investigated through interviews and questionnaire survey. It can draw attention to "backward students" vulnerable groups, provides a reference method to protect their rights, and adapt to the reform of education direction, has certain theory and practice significance. Due to the objectivity of middle school "backward students" lack of equal learning rights, the external factors of the lack of learning rights has been investigated and analyzed in this paper, mainly form three aspects of school, family and society to explain.The Y middle school has been taken as an example in the second part, it has described the current situation of the "backward students", mainly from the school teachers and students cognition of learning right to describe, and has analyzed the root of "backward students" lack of equal learning rights. The root of the problem is divided into three aspects: at the first,"backward students" is not respected in the school. The teacher’s subjective attitude, students’ individualism and the unequal distribution of school teaching resources, making the "backward students" learning rights implementation is not in the same place. Secondly,"backward students" not to be understood in the family. The old education idea of the parents and family not harmonious make backward students cannot be free to develop their own in the family. Thirdly,"backward students" are not recognized in the society. Induced err direction of public opinion and social ethos, make "backward students" fall into a wrong path, unable to fully enjoy equal learning rights.The solving countermeasures have been put forward on the unequal learning rights of the "backward students" in the third part. Mainly from three aspects of school, family and society to analyze, realize transition from autocracy and authority school to democracy and freedom school, from family tradition education to the modern education, from score consideration type to quality consideration type, so that the "three changes" to ensure the implementation of middle school"backward students" equal learning rights.
