| With the continuous development of world economy and the leap progress of modern new and high technology, the process of economic globalization is speeding up and the international trade is driving the global economy forward, at the same time, the cross-border transfer of hazardous waste are emerging. Transboundary movement of hazardous wastes began to enter into people’s horizons since the 1970 s, after decades of time, the transboundary movement of hazardous waste has become a hot issue of the world. Hazardous waste not only causes serious environmental damage to the receiving countries, also causes harm people’s health. By pure international transporting into other countries, hazardous wastes transporting ways also have new development through investment, multinational companies.In order to solve the environmental problems brought by the transboundary movement of hazardous waste has been committed to the development of international society and improve the international legislation on cross-border transfer of hazardous waste, signed a series of global and regional convention, protocol, countries is due to more domestic legislation, basic formed with the core of the Basel convention on control of hazardous waste across the border to transfer the legal framework. Due to the developed countries and developing countries there is a huge economic and technological gap between, also have different interests demand, international treaties and national legislation there are legislation defects and lack of execution. In this paper, based on the research of the related literature at home and abroad, analysis of the relevant international legal documents and the domestic legislation, find out domestic and international legislation on border control of hazardous waste transfer, and the improvement of the related Suggestions are put forward.This paper will be divided into three chapters. The first chapter is an overview of transboundary movement of hazardous waste, including transboundary movement of hazardous waste definition of related concepts, the reason and harm of hazardous waste across the border to transfer and the border of hazardous waste transfer the theoretical basis of legal control. The second chapter mainly embarks from the global and regional conventions, analysis of hazardous waste control the movement of international law, found the advantages and disadvantages, and the international border control of hazardous waste transfer put forward the perfect measures. The third chapter mainly from the border of hazardous waste transfer legislation present situation in our country, analysis of the deficiencies, and combining with China’s national conditions, to regulate the cross-border transfer of hazardous waste in China is more measures for perfecting the frontier. |
