| Legitimacy of public policy is an organic unity including “The policy is identifiedâ€and “The policy is worth identifyingâ€.The former is a judgement from empirical facts, but the latter points to the policy value itself. In the modern democratic society, “The policy is worth identifying†has become a necessary condition for “The policy is identifiedâ€.In recent years, frequent events about ethics anomie among primary and secondary school teachers persuade the government to make a series of policies which aim to regulate teachers′ ethical behavior However, some of these policies failed to effectively prevent and decrease teachers’ ethics anomie. The practical dilemma of the damaged policy authority and the lack of effectiveness prompted us to reconsider the legitimacy of the policy.With the development of legitimacy theory,three kinds of theory analysis framework gradually have been formed which include Rational Constructivism, Empiricism and Normativism By comparison, this study points to the one-sidedness of both Rational Constructivism and Empiricism and the defects of governance policies based on these two kinds of legitimay theory, which aimes to restrain teachers’ ethics anomie in primary and secondary school. However, Normativism of legitimacy theory critically inherits the former two theories’ reasonable core, corresponding to the requirement of democratization and modernization about teacher’s ethics anomie governance in the primary and secondary school and lays a theoretical foundation for this study.Under the perspective of Normatism, the legitimacy of public policy ought to include legal policy subjects, legal policy content and legal decision-making procedure.Through individual interview and policy text analysis,this study presents the current actual status of the legitimacy of primary and secondary school teacher’s ethics anomie governance policy. About policy subjects, as important direct stakeholders,teachers have insufficient participation in the process of policy making.As for policy content, there exists generalization of teacher’s ethics anomie behavior, ambiguous "action statement", undefined "results statement";Policy decision-making process is incomplete.The policy legitimacy crisis of primary and secondary school teacher’s ethics anomie governance has emerged.To explore the causes of policy legitimacy crisis of primary and secondary school teacher’s ethics anomie governance.Compared with the government and social force,teacher group is always in a weak position in the game because of Hierarchical governance pattern and insufficient professional association.The status of policy participator is marginalized directly damaged the legitimacy of the policy subject.The strength of the instrumental rationality and the decline of value rationality lead to some policies of primary and secondary school teacher’s ethics anomie governance have become a tool which controls teachers by the administrative department of education, generalization of teacher’s ethics anomie behavior hurt the legitimacy of the content of the policy.The decision-making mechanism of the government is incomplete leads to the legitimacy crisis of the decision-making procedureIn summary, the diversification of policy subject and organized well, policy content conforms to the accepted value, scientific and reasonable decision-making procedure are inevitable requirements to make the policy deserve identifying.On this basis, the article put forward the following strategies: Firstly, To transform hierarchical governance to the policy network governance.Construct the policy network of primary and secondary school teacher’s ethics anomie governance on the premise of that making the policy subjects keep balanced.Secondly,The content of the policy ought to meet the conformity to aim, worthwhileness and regularity.To realize the conformity,draw a border of teacher’s ethics behavior to avoid the generalization of teacher’s ethics anomie behavior;To realize the worthwhileness,all policy subjects in the policy network ought to consult to avoid pressing;to realize the regularity,draw the levels of the teacher′s ethics behavior, act according to levels.Thirdly. The decision-making process ought to limit abuse of power, ensure the operation of the policy network in an orderly way. |
