Study On The Legal System Of Export Credit Insurance

Under the environment of economic globalization, the issue of export can play a crucial role in many aspects, such as the promotion of national economic output, the enlargement of employment, the balance between international income and expenditure,and so on. China as a country that has great trading power, Chinese international import and export trade is very complicated, adopting the means of export credit insurance transactions, which has become the choice for a lot of importing and exporting enterprises. However, at present, China has not enacted a special legal system regulation for export credit insurance, therefore, as for The level of legal system construction, the export credit insurance is still in the backward position. The lack of this system has made it difficult to play its promotion role for credit insurance in export trade, which also has made the relevant trade activities meet huge obstacles. Therefore, the research on the legal system of export credit insurance can have great theoretical and practical significance.This paper has analyzed our country legal system of export credit insurance mainly from the four parts, through the comparison with the developed countries（regions） on system and practical experience, hoping to contribute to building and improving the legal system for export credit insurance in our country.In the first part, it is mainly about case study. Mainly from the case between Sinosure Company and "Xi Wang Group" that had encountered overseas open unreasonably refuse to pay the issuing bank, as well as the case that Sinosure Company actively paid the loss of customers that had encountered political risks during the political turmoil in Libya. Through the service of claim, Sinosure Company can provide a good guarantee for our country’s enterprises in overseas trade.In the second part,it is mainly about the foreign regulations of export credit insurance legal system.First of all, it mainly introduced the legislation in Britain, Japan, France and other countries（regions） about the provisions of export credit insurance. Secondly, it mainly made detailed explanation about the specific provisions on export credit insurance agency business model and business scope in different countries（regions）, as for the choice of operation mode, the UK directly adopted operation mode handled by the government; the French chose the management mode of private joint venture with the government, but controlled by the government; Switzerland adopted the special mode of government plus companies, namely, double track management, while the region of Hong Kong chose the operation mode that government set up wholly-owned subsidiary to have indirect management. At the same time, based on the different operation modes, the business scopes of various countries that are engaged in the export credit insurance companies（regions） are not the same. Finally, this part made analysis and discuss on the latest development of international export credit insurance.In the third part, it makes study on China’s export credit insurance system.It studies mainly from the background of export credit insurance system and present situation,analyzing the whole process of the generation and development of export credit insurance in China,so as to make analysis on the running process of export credit insurance in practice,which aim is to have comprehensive grasp to the operation of the export credit insurance legal system in our country.In the forth part,firstly,it makes analysis on the problems existed in the current export credit insurance legal system,secondly,it make studies on the reasons of the legal system of the export credit insurance and the necessity of perfecting the legal system of the export credit insurance.Lastly,it puts forward some suggestions and methods to improve the legal system of China’s export credit insurance.
