A Study On Several Problems In National Legislation Of Export Credit Insurance

Export credit insurance is an insurance system established as a policy by the government to advance domestic trade and to guarantee the remittance collection of export enterprises. Compared with the history of export credit insurance system, its foundation in our country is later. Its scale and rate still can't fulfill the large need of the fast increase of foreign trade. Although lately modify foreign trade law of PRC have already confirmed the law position of export credit insurance, there is no specialized law of export credit insurance in our country. This is very disadvantageous in development of export credit insurance. Therefore, it is a most valuable thing to studying some problems of national legislation of our export credit insurance system. The article starts from analyzing the necessity of national legislation of export credit insurance, to provide basis whether our country should set up the law of export credit insurance. Thereupon the way of comparison analysis and combination of theory and practice have been adopted in the article. Through the comparison between alien law on export credit insurance and ours and induction the new development of international practice of export credit insurance, the experience which our national legislation of export credit insurance can draw lessons from is provided. The last part of the article, through studying some concrete problems of legislation, puts forward some advice which will do better to the national legislation of our export credit insurance system.
