Study On The Relief System Of Adverse Drug Reaction

As an old saying goes: " When Medicines Become a Risky Mix ". There was a certain combination of being very helpful in what drug was, but also harmful. Frequent adverse drug reaction(hereafter referred to as ADR) in recent years result in serious damage in people’s physical and mental health and property and now has increasingly become a social problem. Well-established system has been set up in region and country where the rule of law was firmly recognized.This article begins with background and significance of the ADR relief system and then introduces and compares its research situation at home, providing a theoretical basis and guidance for this paper. In the second part, mainly focused on the basic concept of ADR, also researched and analyzed the legal liability and the principle of responsibility imputation. Through analyzing on the relevant law of the ADR relief, pointed out problems in current law and practice of ADR relief. Comparing and studying Well-established system in Chinese Taiwan and developed country to provide reference for a better established system and also to provide basis in reality. New ways for system construction was put forward in the last part. Combining the legal education and ADR relief and providing different contents to different subjects to make a contribution for ADR relief.This paper uses the methods of data analysis to point out the severity of ADR problems in our country and the urgency for a well-established system. Using the methods of literature analysis and policy analysis to show situation and existing problems in current ADR. With the method of comparative study, this paper introduces the perfect system of ADR relief in Chinese Taiwan and at abroad. Finally, drawing lessons from overseas experience, combining with the actual situation in our country, to put forward ideas of construction of ADR relief system in China.
