By 2013, Hohhot the "lose the one-child family" has reached 218, due to the only child’s early death, most of the aging parents have to face the endowment medical difficulties, the physical and mental trauma, poverty, birth again or adoption difficulties,and a series of practical difficulties. However, at present our country legal science attention to such problem is far from enough, fuzzy legal rules and regulations and policy documents a series of problems such as insufficient system specification, make the "lose the one-child family" right to survival, development and protection of tilt, and a series of rights can not get effective remedy.Based on the Inner Mongolia Hohhot "lose the one-child family" as an example, the thesis mainly through five parts to research the problems faced to the "lose the one-child family". The first part of the thesis introduce the historical background, the research origin and expounds the research significance of the "lose the one-child family". The second part depends on the data of the relevant departments research to the Hohhot "lose the one-child family" and the author through individual interviews to understand the "lose the one-child family", to analyze the present situation of the "lose the one-child family". The third part according to the theory of jurisprudence, further puts forward the "lose the one-child family" right to relief the legal basis and necessity. The fourth part, according to China’s existing laws and regulations and policies of the Inner Mongolia autonomous region and the social from all walks of life to the present situation of the right remedy for the "lose the one-child family", finds out about the "lose the one-child family" right remedy problems that must be solved. The last part in comprehensive summary on the basis of the above several parts, puts forward to further improve the "lose the one-child family" rights relief system of some specific Suggestions.
