The Research On The Reform Of Land Examination And Approval System Of China

China’s current examination and approval system of land has played an important role on the conservation and rational utilization of land resources, and promoted economic development, however, along with the rapid development of social economy and the practical requirements for conservation of the land, the current land examination and approval system has been unable to solve the new contradictions of land’s utilization. Some of its inherent defects has been gradually revealed, such as the tedious approval procedure, the less-strict regulation for illegal expropriation of land. Based on comprehensive analysis, the main reason is there’re some Institutional defects in the approval system that can’t solve the problems in practice. Therefore, in order to strengthen the responsibilities at all levels on the regulation of lands, and establish the system of examination and approval of land according with the central policy and current economic development trends, it’s necessary to study the reform for examination and approval system in our country.The reform is very necessary. It’s been not only caused the interests of domestic and foreign scholars, also caused the concern of relevant administrative departments such as the Ministry of Land and Resources. But the research mostly concentrate on one of its subsystems, such as land expropriation, there’s less comprehensive research.This paper mainly use the “Regulation theory” and "Balance Theory" as the theoretical basis in view of the current situation and problems, firstly introduce the history of the land examination and approval system from 1949 to the present stage, and carry on a research on the its five parts one by one, namely the land use overall planning approval, land by approval of the annual plan, agricultural land conversion approval, construction project approval, land acquisition approval. On this basis it’s necessary to find the problems and analyze the reasons. With the help of the research on the scholars and experience from developed countries, such as Japan, the United States of America and the United Kingdom and the demands for political decentralization and quick transformation of government functions, I put forward the suggestions including of strengthen the legal regulation of the internal administrative approval behavior, strengthen legal construction, thinking highly of performance assessment, regulating government, adjust the authority of approval, simplifying processes and contents, optimizing the process, improve the supervision mechanism, protecting the legitimate rights and interests of individuals.I hope my research will make some contributions on the theoretical research and practice of the reform of land examination and approval system of China.
