Our country typically has a large population with relatively little land, on the one hand, in order to ensure the country’s food supply, we must carry on the strict protection of arable land, on the other hand, with the dramatic development of economy, the contradictory between person and land is escalating. The first part is introduction, it mainly introduces the selected topic basis, research meaning, research review, research methods and the innovation of the article expected. The second, third and the fourth part respectively introduces the historical evolution of China’s land expropriation examination and approval system, summarizes their characteristics, analyzes the their defects from the aspects of the applicant for land expropriation, the land expropriation examination and approval authorities, the procedures for examination and approval of tax collection. The fifth part introduces the cause of the defects in the existing land expropriation examination and approval system, it states that we have paid more attention to the public interest and despise the private interest, have paid more attention to the efficiency and despise fair, have paid more attention to the entity and despise procedure, because of the three main reasons, problems of examination and approval of land expropriation system in China produced. The sixth part is the theoretical basis for perfecting the current land expropriation examination and approval system, aiming at the defects in land expropriation examination and approval system in China’s reason, it is necessary to go into research by balancing the public interest and private interest, the efficiency and fairness, the entity justice and procedure justice. This way can provide the theory of specific specification for our country land expropriation examination and approval system.
