Study On The Standardization Of The Public Security Law Enforcement

With the rapid development of economy and society, the process of urbanization is getting faster and faster and the social environment has changed greatly, which has directly caused the change of law enforcement environment. Law enforcement work is the lifeline of public security work and the eternal topic of the security organs. The construction of law enforcement standardization is the core of the “Three Constructions ", is to conform to the inevitable requirement of the rapid development of the construction of the rule of law, is to enhance the ability of public security organs to perform their duties of major initiatives, and is the strong guarantee to improve the quality of the construction of public security team. To further promote law enforcement standardization construction, can not only promote the law enforcement ability and law enforcement credibility of the public security organs, but also promote the public security work and the construction of the public security team to a comprehensive, healthy and sustainable development. Back in September 2008, in order to meet people’s new expectations of justice and to meet people’s new requirements of the public security organs, the ministry of public security of the party committee in the national public security organs was deployed to carry out the law enforcement standardization construction and issued a series of documents, such as " Guidance about vigorously strengthening the construction of law enforcement standardization of the public security organ ", "The overall arrangement on law enforcement standardization construction of the national public security organ " and “The stage goals and standards of law enforcement standardization construction of public security organ” etc, and these got actively popularized in public security organs at all levels. In Nantong, Ji’nan, Quanzhou, Fujian, Xi’an, Yan’an and other places, a national meeting was held to continue to popularize them. After that, The 18 th National Congress of the CPC started a further popularization and deployment on governing a country by law. General Secretary Xi Jinping and Premier Li Keqiang made important instructions on building rule of law in China and safeguard the constitutional authority, which required not only to make everyone feel justice, but also required the public security organs to make greater efforts in law enforcement.With the pace of reform and opening up becoming quicker and quicker, there will be a new era of new problems, new situations and new tasks. That makes the law enforcement work faced with more complex social form than before and even there will appear some problems which can’t be solved by law---- the lag of regulatory laws and regulations will be more obvious. From the supervision point of view, the whole comprehensive supervision hasn’t been formed; the system is still not perfect; and the methods are too out of date, which requires the public security organ to improve the supervision of law enforcement and to build the entire law enforcement surveillance platform by using modern high-tech method like the internet. From the point of view, professional talents are lacking; staff incentive system is not complete, and the problem of the retaining and promoting of good legal talents needs to be reconsidered. In the meantime, the shortage of funds is also a bottleneck restricting the development of public security and we should update law enforcement equipment to meet the needs of actual combat. In addition, in actual combat, violent resistance to law often occurs, personnel quality, to a large extent, will affect the power of law enforcement investigators. How to reduce the impact on the police inner heart caused by these problems is also an urgent problem to solve. To sum up, we should analyze from the perspective of rules and regulations, law enforcement and supervision, and study the perfection and optimization of the construction of law enforcement standardization of public security organs, so as to provide a solid and powerful legal guarantee for the people’s life.In order to fully reflect fair, civil, strict and efficient law enforcement objectives of the public security organs, the Ministry of Public Security proposes the construction of law enforcement standardization, which is a very important one among “Three Constructions ". It is a systematic project of constructing the standardization and procedural of law enforcement within the legal framework of law enforcement activities. The standardization of law enforcement is conducive to transparent law enforcement to curb corruption, helpful to improve the efficiency of law enforcement, to ease social conflicts, and reshape the image of law enforcement. In the current construction of China’s rule of law, that is necessary and urgent. Only by studying the basic content of the standardization of public security law enforcement, analyzing of the practical difficulties and causes of the standardization of public security law enforcement, and exploring countermeasure on this basis, can we seek a better way to promote the standardization of law enforcement of public security, and to better promote the process of public security law enforcement.
