Jingdezhen is known as the "porcelain capital". The people there can produce exquisite porcelains, which make the world be profuse in praise. Many masterpieces have emerged in large numbers. "Jingdezhen" is not only a gilded signboard with infinite charm, but also beautiful card of porcelain industry in China. The porcelains of Jingdezhen contain the essence of Chinese traditional crafts and strong regionalism, so it is accord with the protection system of geographical indications. However, our country structured the system of intellectual property after reforming and opening-up. Geographical indications, which exists a lot of flaws and vulnerabilities in legislation and law enforcement, started late comparing with copyright, trademark right and patent right. Jingdezhen porcelain geographical indication can not gain effective protection, because of the lack of protection of geographical indications, the flaws of protection system and the Conflict of protection mechanism have leaded. All kinds of torts in practice have caused irreparable damage of porcelain industry in Jingdezhen. There are two reasons. On the one hand, the business sector and quality inspection department of Jingdezhen are combined, but the double management mode makes Jingdezhen porcelain enterprises at a loss. On the other hand, the lack of the knowledge of public geographical indications, the low protection atmosphere of geographical indications in society, the low protection consciousness of brand among production operators, the deficiency congenitally of industry association, which makes it’s even more difficult to protect the geographical indications of Jingdezhen porcelain. The problems in the protection of geographical indications of Jingdezhen porcelain are highly representative in the field of geographical indications in China, which reflects the seriousness and urgency of China’s geographical indications. The thesis was based on discerning of the concept of geographical indications in connotation and denotation, focusing on the analysis and discussion of several continental and Anglo American law system countries and China’s intellectual property protection mode of geographical indications, and taking empirical research in the intellectual property protection of geographical indication of Jingdezhen porcelain, through field investigation and analysis, putting forward targeted, forward-looking and feasible suggestions to improve he intellectual property protection of geographical indication of Jingdezhen porcelain.
