The Research Of Government Management Mode In China(Shanghai) Pilot Free Trade Zone From The View Of Law

With China(Shanghai) Pilot Free Trade Zone(Abbreviation: CSPFTZ) was launched on Sept 29 th, 2013, CSPFTZ which bears the responsibility of testing government management reformation and economic opening in china’s current situation has explored a number of policy After a year’s running. Along with her expanding, CSPFTZ’s innovation of government Management Mode gain experience and interest for piecemeal expansion in local government. On the other hand, it is widely criticized for CSPFTZ’s short of breach and low progress on reformation, especially on her government Management Mode which is the emphasis and difficulty for the reformation. In domestic theory, more CSFTZ government management research is focused on norms rather than fact of the rule of law. This paper try to clarify the relationship between government and the market on the basis of the essence of the rule of law and promote changing CSFTZ’s government function and supervision mode. Realistically, this paper put forward to the solution principle, path and strategy from the view of rule of law.This paper put more focus on the innovation of government Management Mode and analysis the present situation and problems on the basis of foreign experience and national conditions and finally offer improvements and suggestion. This paper is different from previous studies which focused on CSPFTZ’s background, value and function, and try to find and solve the problems. This paper creatively put forward four reformation principle including risk control, market-oriented, law respect and service first and the plan of three-step strategy. On the above basis, this paper reach the conclusions of reconstruction of law guarantee, list management, post supervision, organization structure, service-oriented government on the newest background of FTZ expanding and "four overall" proposed.
