“The logic of system’s formation is diachronic instead of synchronic.The happening.formation and establishment of system are all completed in time and formed in the activities of millions of people.”In the contemporary social activities, consumer public interest litigation arises at the historic moment.This article is divided into three chapters for studying the consumer public welfare lawsuit system, “As a consumer disputes settlement mechanism of public interest litigation”. “The procedure and supporting system of consumer association to rise a consumer public interest litigation”. “Consumer public welfare lawsuit procedure”.This article is centered with some problems as “The basic legal theory of consumer public welfare lawsuit”.“Who rise the public interest litigation”.“ The scope of public welfare lawsuit”.Finally the article focuses on the final chapter, carrying on construction program of system.The first chapter “As a consumer dispute resolution mechanism of public interest litigation” explores necessity of the public interest litigation as a means of consumer disputes by comparing the reconciliation, mediation, appeals, arbitration and litigation.The second chapter “The procedure and supporting system of consumer association to rise a consumer public interest litigation” is the innovation of the whole paper,which studies from the angle of consumer society. It’s decided to try to build consumer association filed a public interest litigation of the conditions and procedures.The third chapter “The consumer public interest litigation procedure”discusses the construction of the consumer public welfare lawsuit procedure by ten section,involving the scope of accepting cases, the right to claim filed for type, the jurisdiction of the court, the responsibility for legal costs, to accept the review process, mediation and reconciliation procedures, rules of distribution of evidential burden, the consolidation of proceedings and the effect of expansion.
