With the advance of the historical process of human civilization, the rule of law continue to improve, resulting in. The rule of law in a democratic, free and equal value idea as the foundation, so the rule of law, since its inception, quickly won the people’s recognition, and accepted by the people in modern countries. The true meaning of the rule of law appeared earlier in western countries, shows that the process of social and historical development, the rule of law is a necessary stage of modernization of the country. In the process of social practice, the rule of law in the country’s governance shows the superiority and great so that all countries in transition have reference and put it into practice. As the world’s civilizations of China, although out of a national governance characteristic socialist road, but in the era of globalization, China also had the road towards the rule of law. Nearly a hundred years, China has been groping forward in the rule of law on the road, although it has made some achievements, but the construction of the rule of law faces the problem is obvious, the construction of the rule of law and the road is hard.Mainly because of the rule of law is not only a kind of reality, to be more exact, the rule of law is a kind of ideal model. In the process of building the rule of law, we tend to focus on the practice of social rule of law in western countries, which ignores the importance of the rule of law and the social foundation of the development of the. By civil society, not only reflects the political liberation, but also can show people’s freedom and equality, the western rule of law and laid a solid social foundation and development. Separation and the interactive relationship between the formation of civil society and the state, so as to provide the basis for the operation of the modern rule of law.This article attempts to through the relationship between civil society and the rule of law, the analysis determined the civil society and the rule of law, civil society the right to limit the inherent requirements, seek to solve the China law construction way. This paper is divided into five parts. The first part is an overview of civil society. Mainly expounds the concept, origin and development of civil society, the inherent characteristics of exploring civil society, for the explanation of the relationship between the connotation of rule of law and the concept of asphalt two. The second part mainly explains the development of the rule of law, rule of law and focuses on the characteristics, the significance of the rule of law. The third part mainly discusses the relationship between civil society and the rule of law. The rule of law is the authority of the original rules of Civil Society for confirmation, both the source and flow of relationships. The fourth part focuses on the right to limit is the necessity of the rule of law, the rule of law is the substance of public power constrained and restricted, the modern idea of rule of law of civil society breeds. The fifth part is the core part of this paper, mainly explains the use of "civil society" to promote the progress of the rule of law from the Chinese China, civil society and the rule of law the historical lack of civil society and the rule of law, it comes Chinese constructed world background, which talked about the influence factors China civil society and the rule of law and the construction influence.Because of my limited ability, the theoretical assumption that some naive, on the right to limit and the rule of law but can play a valuable role, cause people to think about the Chinese construction of rule of law, and set an example by personally taking part in the later study and work, make our own contribution to the construction of rule of law Chinese.
