"Law-abiding" is not only the basic ideal goal and state of building a rule of law society,but also an important content of building a country under the rule of law and the government under the rule of law.And the discussion of citizens' law-abiding will naturally involve a series of problems: first,what are the criteria for judging the legal and illegal actions of citizens' law-abiding behavior?Secondly,in the face of unjust laws,do citizens have the right to choose disobedience? Finally,how to standardize the standard of citizen's law-abiding to improve the law-abiding state of the citizens.Based on the discussion of this series of topics,western countries have formed a relatively mature theory of civil disobedience as early as 1950 s.Compared with the long history of the rule of law in the west,the construction of the rule of law in China is still in the initial stage.Therefore,our country's research on "the rule of law society" and "the limit of citizen's law-abiding" has a lack of experience.The study of the citizen's law abiding limit not only plays a guiding role in the construction of the rule of law society,but also plays a guarantee for the construction of the rule of law society.So by combining the theoretical research with the case analysis,the author constructs the limitation of the citizen's law-abiding in the Chinese context.Based on the needs of the research,the full text is divided into the following five parts:The first part is the introduction.First,it explains the reason and significance of the topic briefly,then summarizes the related theoretical research achievements both at home and abroad,and finally introduces the research train of thought,method and research emphasis in this paper.The second part is the connotation and theoretical origin of citizens' law-abiding limits in the rule of law society.In this part,we first define the elements of the rule of law society and the connotation of the limits of citizens' law-abiding.Secondly,we comb the theoretical origin of "the limits of citizens' law-abiding".The third part makes a summary of the dispute and shows the basic attitude of the author.This part first summarizes the theoretical controversies on "obeying the law limit" in Chinese and Western countries,and then gives a basic position for studying the limits of citizens' compliance with the law.The fourth part is an empirical analysis of the citizen's law-abiding limit.This part first classifies and analyzes classic cases;secondly,summarizes the behaviors of citizens breaking the law limit;finally,it analyzes the reasons for citizens to break the law limit.The fifth part clarifies the limit of citizen's law-abiding.First,we define the external dimensions of citizens' law-abiding by defining the scope of citizens' law-abiding.Secondly,we construct the internal dimension of citizens' law-abiding by clarifying the sequence of citizens' law-abiding.Finally,we build a comprehensive dimension of citizens' law-abiding by refining the standards of citizens' law-abiding.To sum up,the purpose of this paper is to conduct a comprehensive investigation of citizens' law-abiding behaviors through the combination of theoretical research and case analysis,and then to set up the limits of citizens' law-abiding from multiple perspectives,so as to offer suggestions for improving citizens' level of law-abiding.
