Marx's Civil Society Theory And Its Enlightenment To Chinese Construction Of Rule Of Law Society

Rule of law is an important course in socialism construction.Because it has a tight relationship between social harmony and stability.Meanwhile,it is also an important task in modern socialism construction.Since we entered market-oriented economy,our country has broadened the restrictions of the majors' rights.The citizens have enjoyed some certain rights.Citizens are getting more and more freedom and the right of independence.Democracy has improved rapidly.The development of civil society reflects in protecting the rights of market entities and improving democracy gradually.On the other hand,it is also a process of socialist legal society in China.It is the topic of my paper that how to achieve an effective interaction between country and society,and how to let civil society improve construction of the rule of the law in China.Therefore,it needs to discover the legal implication on Marx's civil society theory which is used to guide the construction of rule of the law in China.So Marx's civil society theory has deep influence on Chinese construction of the rule of the law.First of all,the paper introduces the formation and the development process of Marx's civil society theory.I am teasing the theories from Classical Civil Society to Modern Natural Socialist civil society and Hegel's civil society theory.Among them,Hegel's civil society theory has the deepest influence on Marx.The development of Marx's civil society theory includes 3 stages that are embryonic stage,developmental stage and formation stage.Secondly,the paper expresses the main content and the meaning of democracy of Marx's civil society theory.The content of the paper includes 3 parts,namely,the discussion of civil society's concept and its substance,the relationship between civil society and legal state,the internal structure of civil society and its operational mechanism.There are abundant legal values in Marx's civil society theory.Throughout digging the logical relationship between civil society and rule of the law in China,we can deeply investigate the meaning of rule of law on Marx's civil society theory,which can guide the instruction of rule of law in China.Civil society and rule of law have closely connection.Civil society is the basis of the implementation and development of the rule of law.Rule of law protect and promote the development of civil Society.Finally,the paper deals with the significance that uses the meaning of rule of law on Marx's civil society theory to construct the society of rule by law in our country.Strengthening the construction of rule of law is the requirement of modern society.Meanwhile it also redefines the relationship of society and government.It is good for forming the interaction between society and country.The construction of rule of law need to cultivate the citizens' sense,and improve citizens' spirit of democracy.Meanwhile,at the social aspect,we must fasten the formation of citizens.We should give full play to communities.At the country's aspect,we should build balance mechanism and form the checks and balances between privaterights of the community and national public power.We should also prevent national public power from abusing.So we can improve and perfect the rule of law system.
