Research On Local Politics And Law Committee Coordinating Criminal Cases

In recent years, Local Politics and Law Committee had been taken place into thecusp of public opinion because of frequent criminal injustice. How will the LocalPolitics and Law Committee do? The question sparked author’s interest of research onLocal Politics and Law Committee coordinating criminal cases. The researchactivities were conducted in my own hometown in Zhejiang province. The researchactivities were taken many methods and it mainly was used questionnaires, interviews,meetings and field observations and so on. With above-mentioned methods, the authorcould be more scientific and rational understanding of the current local circumstancesand the problems and found its impact on Chinese judicial legal aspects of running.The author should point out that the advantage of the local Politics and LawCommittee coordinating criminal cases and summed it unreasonable grounds andpropose the solutions. In this way, the political and legal system with Chinesecharacteristics can be run in a well-functioning scientific model and it will contributeto achieve democracy in China and the rule of law in China.This paper is divided into five parts, including introduction and conclusion.Introduction has mainly reviewed the research about background, current situation,meaning and scope, methods and purpose.The first part is about the investigation of Local Politics and Law Committeecoordinating criminal cases. It has three aspects, mainly including the origin,institutional framework and operation. With the empirical research of three aspects,the author could be more clearly comprehend the operation situation of local politicaland law committee coordinated criminal cases and it is the foundation for subsequentresearch in this paper.The second part is the reflection of Local Politics and Law Committeecoordinating criminal cases. This part contains two aspects of local politics and lawcommittee to coordinate criminal cases, which contains existed problems and reason analysis. Through the investigation and analysis of the three aspects of the first part,this paper sums up the reasons of Local Politics and Law Committee coordinatingcriminal cases. And this paper points out that the Local Politics and Law Committeecoordinating criminal cases mainly exists that the right of coordination was vulnerableto abuse, violation of coordination process and coordinators lack of personnelprofessional quality.The third part is the Politics and Law Committee to coordinate criminal caseswhere the way out, which is the innovation of this paper. This paper takes objectiveand cautious attitude to Local Politics and Law Committee coordinating criminalcases and made an objective evaluation, namely: during the Chinese characteristics ofcriminal justice system transformation period, Local Politics and Law Committee hasits reasons to exist. Local politics and law committee plays an important role onprotection of criminal proceedings effectively and realize the effective socialcontrolling, as well as the achievement of the Chinese Communist Party’s leadershipof political and legal work. However, local politics and law committee to coordinatecriminal cases also has inevitable problems, namely:"coordination" obstructs theindependence of the judicial organs exercise their functions and powers, violates dueprocess and damages entity justice. In addition, this paper summarizes the views ofother scholars apart, put forward my own unique view，namely: the reform functionsof local Politics and Law Committee to coordinate criminal cases. Specific reformpath begin with macro and micro perspectives. Through the macro perspective, thispaper mainly thinks that we should improve the party’s leadership and oversight of thepolitical and legal work, to promote political reform and judicial reform and tooptimize the structure of Local Politics and Law Committee. Through the microscopicpoint of view, this paper hold that Local Politics and Law Committee should mainlydefine the content of criminal cases, standardize their procedures of coordination andstrengthen the capabilities of its petition to proceed.The last part is the conclusion.
