The Functions Of Politics And Law Committee In The View Of Judicial System Reform

The Fourth Plenary Session of the Eighteenth National People’s Congress of the Communist Party of China put forward the comprehensive reform of the judicial system and the new functions of the Politics and Law Committee(PLC),so as to find out the contradictions in the existing problems of the political and legal committee.Maintaining judicial independence and promoting the reform of the judicial system are essential.Based on the interaction between the Politics and Law Commission and the judicial department in practice,this paper tries to find out the problems in the specific operation and practical operation,such as the interventions of judicial and functional passive problems,and the weakening of power and lack of professional problems.From the legal point of view,functions and problems exist in the Politics and Law Committee.It is the basis to realize the independence of judicature,to strengthen the source of dealing with petition,to optimize the social environment for the independence of the judiciary,and to improve the social environment by introducing the judicial function.Professional legal personnel from the technical level to solve the legal and legal committee of the lack of legal issues.And ultimately to China’s unique political and legal system can run in a scientific mode of operation,trying to improve the ruling capacity and the long-term and effective role in the rule of law of the Communist Party for construction of the country’s law system.
