| With the rapid development of social economy, the economic benefits to the companyadvertising is immeasurable. China’s current government supervision and management systemfor outdoor advertising is very complicated, duties and powers blurred, bull management,decentralized regulation. The phenomenon of confused oversight and decision-makingauthorities is very prominent, resulting in duplication of regulation and ineffective regulation.Lacking of outdoor advertisement planning brings a lot of trouble administrative counterpart,triggering litigation disputes. Meanwhile, China’s legislation on outdoor advertising is notperfect. This paper selected " Advertising Co., Ltd. Hongsheng Qiandongnan dissatisfied withKaili City Administration Bureau dismantling the outdoor advertising case" to analyze,discuss some of the problems that exist in our outdoor advertising, put forward proposals toimprove the management of outdoor advertising. I hope beneficial practices.This paper is divided into three parts, by the introduction of the case, analyzing theissues embodied in the case and finally put forward their suggestions to improve theseproblems.The first part is a brief description of the case, noted that the focus of the case and theviews of the parties dispute, meanwhile, lists the ruling and the basis of the court. This part isfull and clear description of the case, in order to fully show the whole story of the case, andlay the foundation about the problem introduced in the second part.The second part is based on the first part, summarized the legal issues. As reflected in thecase, namely the nature of administrative act done by the administrative subject, bullmanagement of the outdoor advertising, problems in China’s existing laws and regulations onoutdoor advertising setting and planning outdoor advertising settings. On the bases of sortingout the causes of the problem, the paper also made some discussion.The third part made a number of recommendations on improving our outdoor advertisingpermit to solve problems existing in the institution of China’ s outdoor advertisingmanagement from three aspects, perfecting outdoor advertising legislation, integratedmanagement system, improving the set plan. The article made a number of recommendationson improving our outdoor advertising permit.In China, the local government constantly introduce local laws and government regulations on outdoor advertising management. However, there still many areas that needfurther improvement. This article take the form pf case studies, hoping the vivid example canassist our government departments set out outdoor advertising management institutionslegally, reasonably and orderly. The article discussed the problems existing in China’sinstitutions of outdoor advertising management from a high level and made targetedrecommendations. |
