In our country, the relevantProperty Declaration System only involes declaration, without publicity yet, which cannotmake it work efficiently practically. Therefore, in order to restrict the corruption efficiently,individual family property of civil servant in China should be emphasized its disclosure, notonly its declaration. Publicizing the individual family property of civil servant in China is notonly necessary for preventing corruption, but also it is the internal requirement for thedevelopment and imprivement of socialist democracy, as well as the key way for people tostrengthen the supervision of power and democracy.First of all, the theory resources relevant to property publicity which strives from classicconnotation of maxism writer’s thoughts and classic western theories can be thefoundamentals of the legal principle theory of our country’s property publicity system.Looking at recent political environment in China, a series of policies which is to the benefit ofthe implementing property publicity formulated by China’s top leaders, and the publicopinion base of civilians’ continuously appeal in years, make the possibility of carrying outproperty publicity system in China improve greatly. To build our country’s property publicitysystem, we can draw lessons from the experience of some foreign countries and regions, suchas America’s “non-antagonism†principle and enhancing education of professional ethics,Korea’s specific system contents and sophiscated financial supporting systems, andHangkong’s “remitting†policy and powerful executive agencies and media supervision. Thereare lots of imperfect and unscientific aspects on the setting of system contents for existingcadres repoting significant matters. Thus many regions carry out some pilot practice onproperty publicity spontaneously. Although it is an improvement to some degree, the publicityis still halfway, the supervision is still inadequate, and the implementation of the system isdiscontinuous. In terms of carrying out property publicity, we are still faced with someresistance factors such as the necessarity of maintaining political srability, the resisting of thevested interests, conflicts of privacy, the incomplete supporting systems, etc. Consequently,we need to make scientific and systematic design for the system, which can be constructedfrom the seven aspects: scopes of the declaration subjects, types of declaration items,limitness of declaration time, setting of executive authorities, patterns of property publicity,mechanism of supervising and reporting, and accountability of offenders. Meanwhile, it isnecessary to formulate liable route map for the implementation of the system: the first step isto improve the supporting measures to to prevent the outflowing of funds and guarantee theoperability of the work of property review; the step is to carry out legislative guarantee for thestrong backing of implementing systems is to promote the systems to the legislative levels;the following step is to publisize the property of the top political leaders and the newlypromoted leaders for the property publicity of top political leaders can work as a “promoter†and the property publicity of newly promoted leaders can help decrease resistance of carryingout the system; the next step is to set a “mitigation phase†for the corrupted ones for it canefficiently defuse the resistance of the vested interests to guarantee social stability; the finalstep is to strengthen the mechanism of examination and accountability and encourage themasses to participate in the supervision positively for it is the key point for the system to beimplemented effectively. All in all, the entire route map is to push the improvement of theimplementation of the system based on the principle of transiting step by step, and eventuallybring it into the system of preventing and punishing corruption in China. |
