This article starts from the connotation of vocational schools, rights, rights of teachers to clear six fundamental rights of education in vocational school teachers, such as right of teaching, scientific research, managing students, getting remuneration packages, democratic management and continuing education according to relevant provisions of the Teachers’ Law, otherwise, it interprets the study of teachers’ rights theoretically by law, comprehensive human development theory, Maslow’s hierarchy of needs theory, equity theory. Research on the issue of teacher’s rights of secondary vocational school will help to promote the basic strategy implementation of the rule of law and the rule of law to teach, and promote vigorously development of vocational education, and conducive to further improve laws and regulations to promote educational administration, will help to reform and innovate the management system of vocational school, otherwise, help protect the legitimate rights and interests of teachers in vocational schools.The author conducted extensive investigations through questionnaires, interviews and other forms for Fuzhou, Sanming, Nanping, Quanzhou, Ningde in Fujian Province, covered about5cities,13vocational schools. The author explored the status of vocational school teachers, especially the problems of rights. The reasons for these problems are manifold, the writer believe that education legislation is imperfect, negative public opinion, the school management system deficiencies and poor awareness of their rights of teachers are the main reason. To solve these problems, the author put forward countermeasures and suggestions to promote the realization of the rights of teachers in vocational schools from four levels initially, such as the state, society, schools, teachers themselves. That teachers must have a clear legal status, improve the legal relief channels; enhance positive propaganda to maintain teacher authority dignity; establish a system security system, improve school management system; enhance their own quality of teachers, improve the legal rights awareness.
