Teacher’s discipline right is an educational right and management power, by which the teacher gives negative sanctions to students’substandard behavior according to the regulations in the process of education and teaching, in order to prevent its recurrence, and promote and consolidate students’compliance. But in educational practice, teacher’s discipline right has been misunderstood. In someone’s view, teacher’s disciplinary action is simply corporal punishment; in other’s view, appreciation education and disciplinary education are contrary to each other, which cannot coexist. Thus, controversy arises on the teacher’s discipline right.In fact, discipline sanction and corporal punishment are different in essence:the purpose of discipline sanction is not to punish, but to let students spontaneously recognize their mistakes, and correct the mistakes, and the premise of discipline is not to harm students, but to respect for students. In comparison, corporal punishment is a is a tort, which will surely harm the students physically and mentally. Disciplinary education and appreciation education are both educational modes in primary and secondary schools in China, which exist side by side and play indispensible role. The existence of teacher’s discipline right is reasonable, because it has historical foundations and is in accordance with the purpose of education as well as the requirements of institutionalized education. Thus, it is still allowed by the law. The existence of teacher’s discipline right is necessary, because it’s conducive to improving the comprehensive quality of students, maintaining school orders and promoting the reformation of education. Although in practice there are many improper situation when the teacher’s discipline right is misused, such as abuse, and wrong oblige, improper timing, or inappropriate place of discipline sanction, we can’t deny it at all. Instead, we should find out the causes and guarantee the proper and effective application of the teacher’s discipline right by strengthening the oversight and control of this right from four aspects:legislation, society, teachers and schools.
