Climate warming has become a highly-focused environmental issue. The global environmental problems are related to the common interests of the survival and development of mankind. It becomes a mutual challenge that protecting the environment and reducing emissions of carbon dioxide and other greenhouse gases, which calls for all the countries to try hard to contain. Against this background, development of a low carbon economy is put on the economic development of various countries on the agenda. With the development of low-carbon economy, low-carbon age has become a development trend. Under the background of low-carbon era, Developing low carbon economy and protecting environment are good excuses for the developed countries to implement trade protectionism, which presents in the form of low carbon trade barriers. Since January 2013, the majority of our city are under the influence of hazy weather every year in autumn and winter. PM2.5 becomes a new measures of an urban air quality standard. It is an alarm bell for China of crude mode of economic growth which is high pollution, high energy consumption and high emissions. It has become the urge problem that how to change its pattern of economic growth, readjusting industrial structure and develop a low carbon economy. Under this background, the development of low-carbon trade barrier must have a profound impact on China which is our country’s export trade and related legal system construction and even political and economic development. According to this, it needs us pay attention to the research on low-carbon trade barrier.Meanwhile, genetically modified food has become a new issue within the food safety area with the rapid development of the biotechnology. As a newly sprouted thing, the safety of genetically modified food has encountered numerous queries, and many controversies were raised by it. In order to cope with the uncertain risk of genetically modified food, each country has made different regulations and trade policies according to their various legislative intents. The diversity of laws and regulations in different states results in trade disputes within international trade areas. In the meantime, trade barriers of genetically modified food had become a method for developed countries to implement trade restrictions. As an emerging kind of non-tariff barrier to trade, low-carbon trade barrier and genetically modified food trade barrier had green covers in protecting the environment and health condition of human, as well as the purposes for developed countries to protect home products and upgrade the competitiveness by using their advanced technology. In view of this, I propose to classify these two trade barriers as new type of green trade barrier.
