China’s Express Industry Safety Regulation Research

In 2015 government working report, Prime Minister Li keqiang affirmed the development of the express delivery industry and the role of various industries at the first time.Indeed,express delivery companies has made rapid development and connected with the world in quantity,size and quality in short space of 30 years. While the express delivery market shows a picture of prosperity.there comes with many security problems.For example,the passive regulation caused by asymmetric information,inadequate legal systems and lack of enforcement tools leads to gaps in oversight and regulatory failure,express practitioners deal with disposal bags illegally and sort savaging caused parcels damaged or lost,express industry organizations have not fully functional.Investigating its reason,the main thing is government regulation,especially the safety regulation is not in place.The supervision of express delivery is that using laws,regulations to achieve the express company acts directly or indirectly intervene,regulate and to achieve the correct market failure and the purpose of maintaining the market order.the regulation of the express is that Express safety regulation is focus on protecting the lawful rights of the parties and all aspects of safety operation,involving the express industry safety supervision and management activities carried out.This paper clarifies the government should be in the dominant position and the duties that is based on the government regulation theory and governance theory in the express industry safety supervision.Then,combined with "poison parcel post evenf" exposed security regulatory issues to analyze the problems and causes that government regulators are in the process of the express industry safety regulation including the government regulators cannot depend on laws in enforcement because of the update speed of laws,regulations is slow,the single regulatory means lead to lots of regulatory loopholes,industry organizations play a week role,consumers lack rights protection consciousness and the effect of social supervision is not obvious.Finally,.on the basis of the experiences that is learned from the western developed countries in the process of express delivery safety supervision and try to build a government regulatory system of government-led and many linkages.First,give full play to the government regulatory functions,including the perfection of laws and regulations,the innovation personnel employment mechanism and the development of e-government in order to realize the regulation means diversification.Secondly,give play the role of industry self-discipline group,especially in the enterprise communication,assist in regulation,makes it the real bridge and link between government enterprises, between enterprises and between enterprises and consumers.Finally,improve the consumers’supervision consciousness and encourage to actively participate in express safety regulation.
