The Legal Right To Know And Its Limits

In a country with an adequate legal system, judicial power is the strong backing for protecting human rights. Judicial process is the basic way that people can use rationally to safeguard their legal rights. The judicial organ is the main responsibility for the guarantee of human rights, and it is the last line of defense for the social fairness and justice. Protecting human rights is the important responsibility of the judicial organs. But the judicial organs should implement fairness and justice in the visible form. The judicial right to know is an important performance of judicial civilization and judicial democracy, and the restrictions of the legal right to know are also necessary in better protecting human rights. The legal right to know is the hot issues for previous scholars to explore. In recent years, the judicial right to know also gradually become a public focus. The purpose of this paper is to analysis the concept of judicial right, to compare the judicial right to know, administrative right to know and the legislative right to know, to summarize the unique connotation of judicial right to know, and to analyze the hidden meaning of the judicial right to know in constitution. Combined with the actual situation in our country, this paper analyzes the current situation, the present-existing questions and the reasons of the judicial right to know, and also expound the safeguard measures of the judicial right to know. By analyzing the conflicts between the judicial right to know and state secrets, commercial secrets, and personal privacy, the paper proposes to find out the solving measures, and put forward the personal opinion of the boundary to judicial right to know. At present, with the advancement of our country under the rule of law process, the judicial protection of human rights has got unprecedented attention. It is believed that through efforts, citizens’judicial right to know will get full safeguard from the judicial organs. Citizens can also reasonably use and safeguard their judicial right to know.
