The Judicial Procedure Guarantee Mechanism Of Public Research

Judicial publicity is a basic principle in modern judicial activities which is established by the international principles and constitutional laws in various countries.Although the number of theory study about the judicial publicity institution in our country is increasing,however,this system is facing a series of problems such as lacking of institutional guarantee,absent of external supervision,and missing the relief system of the violation of legal procedure.Therefore,it’s urgent to our country to build a perfect procedure safeguard mechanism of the judicial publicity.This thesis try to study the safeguard mechanism of judicial publicity by focusing on three parts involving the present situation,present matters and troubles.Based on the results of comparing the present situation and the trend of development of the judicial publicity safeguard mechanism in foreign laws and the fundamental realities of our countryand the judicial practice,this thesis raise the methods to solve the issues.Improving and refactoring the safeguard mechanism of the judicial publicity of our country,to supply the system guarantee and procedure remedies to our people,which may help breaking the troubles of current system,and providing theory reference for our judicial organ to advance judicial publicity and promoting judicial justice.
