In recent years, with the booming enrollment of colleges and universities and the popularization of higher education in China, education scale in colleges and universities has been expanded and the economic activities involving those schools are increasing while their contact with society is becoming closer. Accordingly, commercial bribe in colleges also has caused extensive attention from the whole society and commercial bribery crimes in those institutions tend to increase. Commercial bribery crimes in colleges and universities are the negative results of social progress and development and will definitely bring huge damage to China’s universities. The development of universities abroad has proved that commercial bribery is a difficulty which needs major efforts to be solved for universities. With increasing impact of market economy on China’s higher education, they are involved in more and more economic activities. Therefore, commercial bribery crimes have become a great problem plaguing the development of China’s universities like in other counties in the world. Especially in recent years, for deepening reform in universities, the expansion of school sale and larger enrollment of students, more and more commercial bribe crimes are happening in the universities. In this case, it is practically necessary to study the situation and existing problems of commercial bribery crimes in China’s universities and to make some useful suggestions.Commercial bribery is the impact of the negative factors of market economy on China’s higher education. The impact led to corrosion of a large amount of leading cadres and staff in China’s universities and damaged the social image of universities. At the same time, it damaged greatly vital interests of teachers and students and all Chinese people. This article firstly defines the meaning of commercial bribery in colleges and universities and introduces its forms, then analyzes the present situation of commercial bribery in colleges and universities and the problems existing in the activities against commercial bribery and finally puts forward some targeted countermeasures against commercial bribery in colleges and universities on the basis of the experience of foreign universities. Commercial bribery in China’s universities characters fixed areas involved in commercial bribery, hidden bribery causing difficulty to investigate and collect evidence, diverse bribery ways and personnel collectivization of the bribee in colleges and universities. Commercial bribery in China’s universities is concentrated in three areas:material procurement, basic construction and the rear-service industrial. There are some problems in the work against commercial bribery in colleges and universities. Legally, there is lack of well-developed law and regulation system. As to the judicial punishment, the punishment penalties is so lighter that warning effect is very small. The work against commercial bribery in China’s colleges and universities is systematically complicated. So we should take many measures on the basis of the experience of domestic and foreign universities in against commercial bribery. We should perfect the legal system construction to make they dare not to commit crime, push de-administration of colleges and universities to make it difficult to crime and strengthen the supervision mechanism to make it impossible to crime.
