Protection Mechanism Of Chinese Disabled People’s Rights And Interests In Public Governance Perspective

China has gradually established disabled people human rights guarantee “Single element” mechanism adapted with political system and led by government since the foundation of new China, which has positive effects on maintaining disabled people’s rights. However in recent years the status of disabled people’s rights guarantee is not so optimistic and phenomenon of infringing disabled people’s right is happening repeatedly like “ Sinkiang mentally-disabled indentured laborer ” which triggers the attention and concern from the whole society to guarantee of rights of the disabled. And this also demonstrates that China’s interests and rights guarantee mechanism for disabled people are not entirely satisfied and there are even some serious defects; we need to locate the key issues that restrict the guarantee of disabled people’s rights and interests, analyze the reasons of those exiting issues and putting forward solutions.This article explains the background and content of public governance and its theory, aspects of the transition from disabled mode, the goal of good governance, governance, performance, etc, analyzes the necessity and possibility of public governance in promoting and perfecting the system of safeguarding rights of disabled people on the base of literature review and definition of related concepts. With Sinkiang mentally disabled indentured laborer as the entry point, case analysis methods, analyze the current situation of safeguard system of rights of disabled people in our country,considering one dimensional government management system is the root cause of inefficiency in protecting disabled people. The last chapter gives suggestions about perfecting the safeguard system of protecting the rights of disabled people in the view of public governance.From the perspective of governance body, the article advocates breaking the monopoly of government, making parts including government, CDPF, social organization, self organization for the disabled, media etc. to play their roles in protecting the rights of disabled people which reflects polycentric governance, helping to achieve the interactive situation with different parts perform their own functions and cooperate with each other. From the perspective of basis of governance, it is crucial to focus on both national legislation and social consensus, emphasis that promote the rights of disabled people by means of International Corporation. From the perspective of governance ways, transform from” the up to bottom “one dimension to allowing other parts to participate in government decision making and execution, realizing interaction and network-based interactive execution. In a word, persisting in improving government’s function, highlighting the positive role of the third sector and the disabled in safeguarding the rights of disabled people, helping to achieve the goal of good governance in protecting the rights of the disabled.The thesis is divided into four chapters.Chapter one: introduction. The paper introduces the research background, research status, research methods and ideas, the core concepts, and determines the research ideas and the basic framework of the thesis. The second chapter: the theory of public governance and protection of the rights of the disabled, introduce the changes of public governance theory, the background and main points, analyzes the feasibility and necessity of applying the public governance theory into the protection of the disabled. The third chapter: Chinese current status of protection of rights of the disabled and their reflection. First introduce the current situation of this mechanism, for example, “Sinkiang retarded enslaved worker”, using public governance theory frame to analyze the main problems of protection of rights of disabled persons in Chinese current system, reflecting the defects and the reasons of the phenomenon of security system. The fourth chapter: Constructing the mechanism of Chinese disabled person’s rights under public governance perspective. Based on the public governance theory, construct the network of mechanism of protection of rights of disabled persons. In the governance body, showing multi center governance situation, the government, social organizations, persons with disabilities,disabled self organization, media;in the governance way, countries advocate legislation and social consensus;in the path of governance, through participation, consultation, dialogue form; in the way, promote the rights of the disabled in china through international cooperation. Finally, a brief conclusion is the review of the full text. Point that the use of public governance theory has problems and shortcoming in the research on Protection mechanism of Chinese disabled people’s rights and interests.
