Mobile vendors are the important components of non-public economy in our country, on the one hand, mobile vendors has the vital significances on promoting our country’s socialist market economy, perfecting the urban functions, covenanting people’s life, solving the employment problems of the low-income groups and promoting the process of urbanization; on the other hand, mobile vendors mainly distribute in the city, which brings the negative effects like environmental pollution, noise pollution, strong-arming and affect the market order and so on. The prohibition of mobile vendors reflects the rules and regulations don’t match with the social development needs, from the point of the present situation and developing trend of mobile vendors, which can’t be solved by only prohibiting the development of them. With the rapid development of mobile vendors, more and more problems brought by the mobile vendors, and large number of stakeholders involved, so it is pressing for countries to find a legitimate and reasonable solution as soon as possible to solve the problems of mobile vendors.At present, the study on mobile vendors in theoretical circle are relatively weak, and the management of mobile vendors in different regions is still in exploring stage, the author thinks that the problems of mobile vendors management is rooted in legal regulations are not perfect. Combined with the status of China’s economic and social development, the existence of mobile vendors have many reasonable places, to study the mobile vendors legal regulation problems not only meet the needs of the development of society, more conducive to promote perfecting civil and commercial legal system in our country. Therefore, to perfect the legal regulations of mobile vendors have both legal and realistic basis, countries should gradually achieve the standardization of the management of mobile vendors on the premise of rationalization comply with the demand of economic and social development. Based on the present situation and problems of the mobile vendors legal regulations analysis, this thesis respectively from two aspects of legislation present situation and the judicial present situation analyses the present situation and problems of legal regulations of the mobile vendors and analyses the obstacles and barriers of mobile vendors legal regulations through empirical analysis, comparative analysis from the national interests, mobile vendors’ interests and social interests and of mobile vendors legal regulation method to reject and suggest to definite the mobile vendors’ principal position, and prompt the business rights into the constitution, establish special laws about mobile vendors management, improve mobile vendors management mechanism and other measures to improve the legal regulation of mobile vendors.
