The Generation And Regulation Of Network Rumors

China has entered a “national network” era since2009. The networkplays an indispensable role in social lives, information exchange, andmarketing. It has greatly changed our production and life style. While thefreedom of expression can promote our self-improvement and socialdevelopment, it also makesand spreads different kinds of network rumors,jeopardizing the interests of citizens and social orders.It is an importanttask for us to clear the boundaries of free expression and to improve legalregulation on network rumors, therefore the healthy and free networkexpression can be guaranteed.At present academic research on network rumors is not adequate.Neither is the legal system. The boundary between freedom of expressionand network rumors is vague. The content of legal norms is short ofpracticality.Based on the analysis of theoretical research and legal norms, thispaper analyze the legislation and enforcement issues of thenetwork rumors, combing with the administrative practice cases of2013.Also I put forward some advice to solve the current problems. This paperis divided into five parts: The first part is an introduction, describing the background andsignificance, research methods, the status of research and innovations ofthis article.The second part is theoretical analysis of network rumors,including the concept and features of network rumors, the concept andvalue of freedom of expression, as well as the basis and boundaries ofregulation.The third part introduces status of legal regulation on networkrumors, including the existing legal norms, their specific contents andrelevant analysis.The fourth part analyzes the administrative enforcement practice,including an overview and details of case analysis.The fifth part presents the problems of networks rumors regulation,including legislative problems and enforcement problems, then putforwards some suggestions.
