Although the concept of network freedom of expression is not written into law, but it has been widely accepted in the theoretical research and social practice. Because of the freedom of expression is expressly stipulated by constitution as a basic right, with the rising of new media, the right of network freedom of expression is also highly empowered by constitution. But just because the constitution guarantee this right, which is an absolute right itself and can be exercised alone and without any help of others, like a runaway horse with no halter, the internet user often overlook its boundaries and violate others’ rights in exercising of the right. What’ more, the trend of violation presents an upward tendency in a straight line and has been widely discussed by scholars and society. In this context, the question how to regulate the freedom of network expression has become a topic worthy of study.This essay consists of three parts. Part 1 is research summary, which is talking about the current situation of theoretical research in terms of the network freedom of expression learnt from reading lots of literature and material. Part 2 is main body of essay, which starts from the concept and definition of network freedom of expression to get a clear understanding of the scope of the research, and then discusses and induces the phenomenon of abusing network freedom of expression and its harmfulness, at last, after analyzing china’s current situation and inadequacy at aspect of legal regulation on network freedom of expression, and absorbs experience of other countries, and finally puts forward some feasible suggestions to benefit the healthy development of excising network freedom of expression in our country.
