With the function of the means of law highlighting, the author attempts to usethis method to explore the possible key point of the rights and interests dispute overSouth China Sea between China and Vietnam. According to the the way in evidencecollection that the International Court adopts key evidence from numbers of evidencein its international lawsuits over territory, the concept of key point is concluded. Itcan be crucial date, key evidence which both parties have no dispute and agreed inwriting and collateral or supplementary evidence under the circumstances of lackingcrucial evidence.The macroscopic reason of selecting is the international lawsuitsover territory especially the Asian ones which the ICJ have judged, and the reason isspecifically the relevance and the evidence effect.On the basis of evaluating the existing so-called key points including the1887Sino-Vietnam Convention, Vietnamese maps and historical evidence, the essayexcludes the possibility that they become the key points. Likewise, in accordancewith the relevance, the effect and the attitude Vietnam(France) displayed, itconcludes that the acts of state sovereign of China in South China Sea can be the keypoint of the dispute. Hoping this thesis can provide some new thinking direction forthe ocean and island issue between China and Asian nations including Vietnam.
