This thesis intends to research on the counterpart’s assistance during administrative investigation. The legal connotations of administrative investigation will provide a foundation on the understanding of the counterpart’s assistance. The thesis includes four sections:Chapter I is a briefing introduction to the purpose, research achievements and the research methods of the paper. Chapter II conducts full analysis on the connotations of administrative investigation and due process which will provide theoretical basis for next chapters. Chapter III introduces the assistance from administrative counterpart, including the definition, classification and value of research on the counterpart’s assistance. Chapter IV intends to give a frame of the counterpart’s assistance.As the most important tool, administrative investigation is often been misused, and as a consequence the counterparts’benefits are often suffered from illegal behavior. The thesis build its research on this theory:the counterpart’s assistance is both the right and obligation of the counterparts. And the counterpart’s assistance is classified to compulsory assistance, the right to assist and the factual assistance. The scholars rarely conduct research on administrative investigation, let alone the assistance from the administrative counterpart. This thesis adopts the law analytic method to analysis three types of assistance which will provide a complementary part for previous studies and will provide a positive path for administrative counterparts to take part in the administrative process.
