The Analysis Of Chinese Ancient Exemption Phenomena Study The Ancient Chinese Imperial Power Of Law From Different Aspects

In Chinese ancient history, the pardan systerm was a symbol of the highest ruler’s authority,charity and the pauler of moralizing.thus every emperpr of the past dynasties all had a favor to it.The pros and ams of the pardon system has always been a bone of antention aming histioans and jurists. Some of them believe the pardon system can promote the developing of country’s politics and society,while others fell the pardon system has a bad effect on the country’s governing.This paper aims to discuss the relations between the ancient ancientimperial power and the law system from a view of ancient pardon system. As to the pardon system,this paper andyses most of former people’s definitions of pardon and expreses my under stand and classification of these definitions.And as to the relations of the ancient imperial power and the law,this paper tries to do a deeper research relations by intersecting comparison.The autor thinks the pardon system is a developing process that its measures became more mature and that its purposes became a destryction of imperial power from an atonement to fegal deficenties.During this process,different dynasties continually innovate the pardon systerm,including the increase of pardon hames and types,even the rulers’ preferences.Despite this,there also have some similarities,such as the diversity of name,the fluctuation of frequencies and the repression of implementation,etc.so its not hard to say in the feudal period,legislators, judicials and the executors are the same one.The rulers’ subjective will decides whether the law is legal of feudal era.The tyrannic authority ean not make the pardon supply the analysis of the pardon systerm and adeeper analysis of the relations of the imperial power and legal system,this paper aims to arise people’s thinking about the imperial power and legal system,this paper aims to arise people’s thinking about the ruling by man and ruling by law,thus could compensate the weakness of the study of the pardon systerm to some extent.
