Thinking Of Economic Law To Promote The Development Of Cultural Industries In The Western Region

As the concept of the culture industry has been always a controversial topic,different countries and related researchers have different understandings and definitionsof concept on the culture industry. Based on the definitions of the culture industry athome and abroad，a concept is proposed that the culture industry in nature is neitheronly spreading culture nor only profiting, but to profit with culture as its carrier and tospread culture along with profit, so the cultural industry refers to an industry and itsrelated activities that is both engaged in cultural production and service to spreadculture and profit for the dual purpose. Based on the development of the culturalindustry in the western region and from the perspective of economic law, the culturalindustry in the western region is analyzed, insightful suggestions and measures isproposed, and effective economic legal system is planned, then the development of thecultural industry in the western region and the prosperity of the whole culture industryall over the country is promoted. In this article it is claimed that the necessity ofeconomic law in the western development of cultural industry should made clear beforethe economic legal system can play positive role of the cultural industry in westernChina. So the development of the cultural industry of the whole nation and the westernregion is discussed, then the effect of economic law to the development of the cultureindustry in western region is expounded mainly from the perspective of society,economy and culture. Secondly，it is mentioned that if the economic legal system willplay a positive role in the cultural industry in western region, the current legal situationof the whole nation and the western region must be mastered better from the overall andlocal, from the current legal situation of developing cultural industry in China and theeconomic law system of the cultural industry in western region. In addition，theeconomic law that is advantageous to the development of the culture industry in westernregion from the foreign legal system of developing the culture industry is used forreference. Through the above analysis and discussion, finally countermeasures andsuggestions of the economic law is puts forward to strengthen the cultural industrydevelopment in western region. First of all, the basic principle that must be adhered to isexpounded, such as resource optimal allocation principles of economic law, moderategovernment intervention of economic law, economic efficiency principle of economiclaw and social standard principle of economic law, etc. Secondly through formulatingthe basic law of the culture industry, improving the each department of law of theculture industry, improving the legislative level, coordinating the related legal measuresof China’s culture, the legal system of China’s cultural industry can be more sound, thenthe legal system of finance, revenue, market management, finance and investment to promote cultural industry development in western region is put forward, then theprosperity and development of the culture industry in western region will be improved.
