This is a translation report according to Chap.16(Civil Procedure) ofIntroduction to the Law of the United States by David S. Clark and Tugrul Ansay. Inthis book, the judicial system of America is studied by several knowledgeableprofessors from the aspect of comparative law. And it is an excellent book ofAmerican law.The American Civil Procedure is roundly presented in Chap.16, including thehistory of civil procedure, nature, jurisdiction, complaint, discovery, trial, executionand appeal etc. Since the Chinese law and American law belong to the different legalsystem, their civil procedures differ from each other. However, with the developmentof common law system, continental law system and the international communication,a trend of less and less difference has emerged. Study on the civil procedure withtypical American characteristics will encourage our efforts to discard the dross andselect the essence and is of vital significance to the development of civil procedurewith the Chinese characteristics.There are four chapters in this report: introduction, the literal translation ofpassive sentences, the free translation of passive sentences and summary. Thebackground and significance of this subject and program are discussed in Chapter1and the literal translation of passive sentences is studied from the aspects of theweakening legal subject and highlight of bearing object in Chapter2. In Chapter3thetranslation skills are discussed during the process of passive sentences translation andat last the summary is given and other points we should pay attention to in translationare also put forward. Through this report, the author expects that the translators oflegal documents can learn something useful.
