China’s economy is undergoing an important period of industry transformation and upgrading. In such a period, profound changes have occurred in every fields of the society, among which labor relations is a very important aspect. China’s labor relations presents two main characteristics in the industrial transformation and upgrading period: the first, in the period of social transformation and upgrade, labor relations has preliminarily established a contracting, market-oriented mechanism, which greatly promoted the flow of talent, created favorable conditions for the development of enterprises, improved the economic efficiency, and pushed the development of the society. The second is during this period, the outbreak of the labor dispute began to concentrate, both in terms of quantity and species, far outnumbered any time before. For the labor dispute, on one hand, due to the embarrassing position of workers unions, which can’t allow workers to express his appeal, the union cannot effectively exercise their rights, to help maintaining the legitimate rights and interests of workers. On the other hand, due to the imperfect laws and regulations, it’s turned out to be no basis when dealing with a lot of labor disputes, which caused arbitration organization into a dilemma. Thus, frictions and conflicts constantly occur between the main sides of labor relations, the rights and interests of workers often suffer because of a relatively strong position that companies stand. And this kind of situation is not conducive to the construction of harmonious labor relations, and will influence the social harmony and stability in the long way. In the important moments of industrial transformation and upgrading, therefore, to study how to establish and perfect the adjustment mechanism of labor relations, reduce labor disputes, safeguard the legitimate rights and interests of workers and enterprise, is particularly important.This paper studies the establishment and perfection of labor relationship adjustment mechanism in the period of industry transformation and upgrading, through the comprehensive and comparative research methods such as literature, characteristics of labor relations in period of industry transformation and upgrading, the present situation and problems were analyzed, and puts forward the importance and necessity of establishment of labor relations adjustment mechanism. By comparison of different models in the field of adjusting labor relations analysis In Japan, the United States and Germany, the three typical developed capitalist countries, it’s meant to provide reference for our country to establish and perfect the labor relationship adjustment mechanism. when the goal and mechanism of labor relations adjustment in the period of industry transformation and upgrading is specified, it put forward some measures and suggestions respectively from the six aspects of clarifying government’s role, promoting employment, promoting employment balance, improving social security mechanism, strengthening the trade union role and functions, setting up reasonable and effective mechanism of fair distribution, improving the legal and moral system to, so as to establish and perfect the adjustment mechanism of labor relations, to provide theoretical guidance to the establishment of harmonious labor relationship and the harmonious society.
