Analysis On The Flexible Law Enforcement Of Urban Management

Nowadays, the contradiction between the city management law enforcementpersonnel and the flow of small traders increasingly exposed, violent conflicts have occurred,this has become the urban management law enforcement work in no way can avoid the problemof. With the awakening of our people in the process of building a socialist rule of law in the legalconsciousness, work on the city management law enforcement work is also increasing, urbanmanagement to implement "people-oriented" flexible law enforcement work is not only themodern socialist rule of law society, but also the urban management law enforcement work mustbe guaranteed.This paper first describes the concepts related to urban management flexible lawenforcement, the enforcement shall include two concepts: the first is the concept of "flexible",second is the concept of "law enforcement". The two are complementary to each other,"theultimate goal of this two concepts of flexible" and "law enforcement" is the pursuit of the unityof justice of law enforcement and law enforcement effect, the legal education and punishment oftwo functional organic combination."Flexible", refers to the process of law enforcement, shouldtry to embody the humanitarian care, ensure effective enforcement of fairness and justice, andimprove the people’s satisfaction of urban management and law enforcement work."Lawenforcement", is the law enforcement power to the reasonable application of law enforcement, onall kinds of illegal phenomenon to give the corresponding punishment, then to safeguard thelegitimate rights and interests are not infringed the law. Enforcement of person is the flexible lawenforcement purpose, should take reasonable and effective, flexible working practices tostandardize the maintenance of the execution of the laws and regulations. This paper describesthe difficulties of flexible law enforcement meeting at the present stage, the main problems are:the law enforcement personnel, quality difference; lagging behind urban managementenforcement of legislation, law enforcement basis insufficiency; some people lack of legalconcept, city consciousness is poor; the public opinion and news media report the one sidedness.And by the flexible law enforcement practice experience of Yanzhou as an example to discussthe way of flexible law enforcement.The method of flexible law enforcement management of small vendors in Yanzhou Districtof Jining city in Shandong Province in the middle way: change the idea, set up the concept ofpublic service; rigid flexible and economic, promote a reasonable standard, law enforcement of law; to guide the small vendors of legitimate business, standardize the supervision management;active please public supervision, strengthen media propaganda, raise public awareness.The Yanzhou area practice experience, and flexible law enforcement measures in other partsof the data to improve the urban flexible law enforcement countermeasures and suggestions:strengthen self construction team, improve the urban quality, improve the level of lawenforcement and the image team; increase the propaganda and supervision, and create a goodlaw enforcement environment; make flexible enforcement of legislation; scientific planning,guide the small vendors of modernization.
