The rule of law is a political structure to manage state and social affairs by law. The rule by law ensure the national social life in an orderly manner and the interests of the people relying on external coercion and restraint. The rule by law or by virtue is complementary to playing a role in governing the country in force by punishing evil and promoting good combination. Communist Party of China use "Rule of Virtue" and "Rule of Law" as a basic strategy of governing the country after the founding of New China.Construction of ecological civilization as an important part of the cause of socialism is protected by the rule by law or by virtue. The rule by virtue can enhance the ecological and moral awareness, foster national ecological moral responsibility, and can create a good social and moral foundation and a good social environment for the construction of ecological civilization. The rule by law can create a harmonious social environment, include the construction of ecological civilization into legalization track, provide an institutional guarantee, continue to promote the protection for the ecological civilization construction. But the status of the rule by law or by virtue for the construction of ecological civilization in our study have deficiencies and gaps for decision-makers and leaders to attaching great importance. Such as lack of capacity building of ecological ethics, ecological and moral construction mechanisms are inadequate on the rule by virtue; lack of legislative, have obstacles on executive and judicial and gaps on the effectiveness of ecological law compliance.At present, under the rule by virtue and by law to promote the construction of ecological civilization require us to strengthen the concept of the rule by virtue and the rule of law, put the rule by virtue and law measures approach into administrative areas. Ethics and legal awareness of ecological civilization is reflected in the party and government policies, guidelines, route. The concept of the rule by virtue and by law reflected in the governing decision-making behaviors, administrative actions, management and service behaviors.The measures under the rule by virtue for strengthening the citizen construction of ecological civilization should be implemented, such as establishment of ecological morality, shaping ecological responsibility, training ecological self and so on. The measures under the rule by law for strengthening the construction of ecological civilization should be implemented according to the spirit of Eighth session of the Fourth Plenary Session, such as developing ecological legal system, implementing the ecological laws and regulations, complying with the ecological law. Establishing and improving the ecological legal system, establishing and improving the ecological law enforcement and law enforcement oversight mechanisms, insisting on the implementation of ecological administrative and green management, raising public awareness and enthusiasm of ecological defend the rule of law.
