| Today most of the wetlands in China exist one-sided focus on economic development, ignoring the wetland ecological protection, which caused all kinds of environmental problems, seriously affect the co-ordination of ecological protection and construction of social and economic development of wetland areas. Wetland is lack of legislative protection at national level for the country, wetland management system disorder and other issues, an urgent need to develop a special wetland laws and build a consummate wetland management system to effectively stop wetland destruction, to curb the wetland environment continued to deteriorate, further development and use of wetland resources.This article based on our wetland resources development, utilization, protection and management status, adopting empirical analysis, comparative analysis, system analysis methods to study the legal issues of wetlands, and learn from the world’s wetlands management legal system advanced experience of wetlands law, institutionalized suggestions and countermeasures, and strive to develop as soon as suitable for China’s wetland protection laws and regulations, under the legal regulation of scientific management and use of wetland resources, to protect the ecological functions of wetlands to cycle orderly development to do something positive exploration.This article is intended to improve public wetland ecosystem services recognize the importance of legal protection of wetlands, for promoting the construction of ecological civilization, build a beautiful China, which has important practical significance.This paper is divided into four parts:the first part is based on a theoretical point of view, the need for legal protection of wetlands was first proposed, overview of the ethical basis of wetland ecology, theoretical foundation, as well as the legal principle of wetland conservation and sustainable development, and summary of the status of the legal protection of wetlands. The second part analyzes the legal protection of wetland problems, wetlands unclear legal concepts, the legal system is not perfect, the management system is not perfect, the subject to the supervision of law enforcement, the responsibility is unclear, wetlands’ownership is unknown. Based on the above-mentioned issues of profound analysis on the proposed legal construction of wetlands need legal innovation and strengthen ecological protection benefits. The third part is the legal protection of the world’s wetlands’advanced experience and learn, first introduced in our country as a party of the Ramsar Convention, the inspiration to implementation of the Convention, followed by the United States focuses on the legal protection of wetlands in three very important philosophy, and three British legal system of wetland conservation. Finally, Japan and other countries in the wetlands of the advanced practice and learn.
