On The Basic Environmental Legal Systems

According to the regulations of making laws for environmental protection, which was present in the report, the legal institutions of environmental protection must be created step by step. Practice for the past 40 years has been made, and the revision of the new environmental protection law with rich enactment of single law of natural resources proves that the legal institutions of environmental protection in China score significant development, and some of them even get more established. In this way, there are a series of laws and institutions can be matched, forming the main body content of the environmental protection law. It is called the basic environmental legal systems for those are comparatively mature in the environmental protection law. The basic environmental legal systems dominates and decide the development of the legal institutions of environmental protection, so to improve the legal institutions of environmental protection is based on to improve the basic environmental legal systems. In this case, the entire system formed by the basic environmental legal systems must be researched as whole, emphasized the connection inside them, instead of separating them as pieces. Nowadays, lots of academic arguments of the basic environmental legal systems focus on such as what’s the name of it, what’s its connotation, what’s the extension and how to identify it, which sets limits on the further research. This paper aims at clarifying the questions about the whole system formed by the basic environmental legal systems as the key, and analyzing the characteristics of the system and the connection between the basic environmental legal systems. Finally, some comments and suggestions of the basic environmental legal systems the will be put forward on the basic of the analysis above.
