Chinese Legal System Of Compensation For Environmental Damage Study

The environmental damage caused by human has resulted in more and more serious global environmental crisis. Due to its danger and complexity, environmental damage has undoubtedly become negative factors which hinder the development of society. China’s trad itional environmental damage compensation law mainly focuses on the compensation relief of property damage, personal injury and mental distress ascribed by the behavior of environmental damage. Compared with the traditional environmental tort through a environmental medium, a certain act of endangering environment entirely possible does harm to environment itself at the same time or separately. The damage suffered by the environment itself is a new type of damage, which does not involve private equity. This kind of environmental damages compensation is rarely discussed domestically, so this paper will analyze this new type of damage.This paper mainly focus on the construction of a environmental damage compensation system, divided into four parts totally. to start with the analysis of the concept of environmental damage, the first part analyzes the characteristics of environmental damage, and clarify the related concept of environmental damage compensation; the second part evaluates our current environmental damage compensation system, and conducts a comprehensive analysis of the problems existing in the new “Environmental Protection Law”;the third part highlights the laws and regulations on environmental damages compensation in the United States and the European Union as well as the reference for our country; with the advanced foreign experience for reference, the fourth part puts forward its own proposals and reflections on the sound of China’s environmental damages compensation legal system.I hope that the previous analysis and conclusions can cause our more attentions and speed up the construction and perfection of environmental damage compensation system, put the responsibility of environmental damage compensation into practice. Thus, it is timely to manage environment and restore ecological system.
