Research On Environmental Public Interest Litigation In China

This thesis studies the establishment of litigation system on China’s environmental charity. Due to the late start of China’s charity litigation and environmental charity litigation, the neglect of the environment for a long time, and the economy policy of implementation of public ownership and planned economy, the environmental law and environmental charity litigation are almost blank. Since the late1980s, China just began to formulate laws and regulations related to environmental protection, but it came with broad provisions, poor operability, and lack of law enforcement. Although our scholars called for a long time for the charity litigation, it was not until recently, the law of China reflected the contents of charity litigation for the first time. The charity litigation still has a long way to go.In this thesis, through in-depth analysis of the concept of environmental charity litigation, elaboration on the difficult status of our existing environmental charity litigation, as well as the comparison of the relevant foreign law, and in consideration of China’s legislature, the judiciary, and special conditions, exploring a way not only learn from foreign experience, but also in line with Chinese culture, and feasibility in operation of the environmental charity litigation system.
